Elgar Parishad case: Activists can seek regular bail, SC says | India News


NEW DELHI: The Supreme Court on Wednesday set aside Bombay high court’s order refusing to extend 90-day time limit to Maharashtra Police for filing chargesheet in Bhima Koregaon violence case.

The SC also said arrested activists may seek regular bail as chargesheet has already been filed.

The top court has allowed Maharastra government’s plea and dismissed Bombay high court’s order granting default bail to lawyer Surendra Gadling in connection with the Bhima-Koregaon case after the police failed to file chargesheet within 90 days.

Now the accused will have to approach trial court for regular bail. The apex court made it clear that the trial court will decide the case on merit without being influenced by the observation made by it in the case.

The Maharashtra Police had arrested five activists — Varavara Rao, Arun Ferreira, Vernon Gonsalves, Sudha Bharadwaj and Gautam Navlakha — in connection with an FIR lodged following a conclave — ‘Elgaar Parishad’ — held last year that had later triggered violence at Bhima-Koregaon village in the state.
